Terms of Use

These Terms and Conditions (“Terms”) govern your access to and use of the ChancebyDrawmax platform (the “Platform”), operated by Drawmax LTD (RC No. 8369691) (“we”, “us”, “our” or “the Company”). By accessing or using the Platform, you acknowledge that these Terms form a legally binding contract between you and the Company. Your continued use signifies your acceptance of and agreement to be bound by these Terms.

ChancebyDrawmax operates a promotional sweepstakes platform via the website www.chancebydrawmax.com. By visiting the website and/or registering/signing up and/or using our services, you agree to be bound by these Terms and any additional terms that may be incorporated by reference, including our Privacy Policy.

For the purposes of these Terms:

• “Player”, “User”, “Entrant” or “Customer” refers to any individual participating in a Draw.
• “Draw”, “Contest” or “Sweepstakes” means any promotional event operated by Drawmax LTD where winners are selected randomly. Participants have an equal chance of winning and may be offered free entries at our discretion where appropriate.
• “Prize”, “Reward” or “Winnings” refers to any item, product, voucher, or monetary benefit won through participation.
• “Ticket” or “Entry” means an opportunity to participate in a Draw, whether obtained through a free or paid method.
• “Token” means in-app credits or digital units used on the Platform.
• “Promoter” refers to Drawmax LTD.
• “Platform” refers to ChancebyDrawmax, owned and operated by Drawmax LTD.

Participation is open only to individuals aged 18 years or older who have full legal capacity to enter into binding contracts. Users may not be Politically Exposed Persons, Heads of International Organizations, or their close associates or family members.

Users must register for personal use only and not on behalf of any third party. Users must complete Know-Your-Customer (KYC) verification when requested. Physical Prizes may be location-dependent and may not be deliverable in all jurisdictions.

Each User may operate only one account. Duplicate or multiple accounts may be suspended, restricted, or closed, and any associated winnings may be withheld.

You must provide accurate, complete, and up-to-date personal information during registration and keep it updated at all times. You agree to keep your username and password confidential and not share them with any third party.

You are responsible for all activities conducted under your account. The Company may conduct identity, credit, fraud-prevention, and other verification checks at any time as may be required by regulatory authorities. The Company will not be liable for losses resulting from unauthorized account access caused by your negligence in safeguarding your credentials.

Each Draw will specify its entry requirements, deadlines, and prize details. Participation may occur through paid entries or free entries which we may offer at our discretion where appropriate. Free entries, when given, are afforded equal opportunity to win.

Winners are determined using a cryptographically secure Random Number Generator to ensure fairness. The Company may adjust, extend, or cancel a Draw at its discretion, with refunds or equivalent credits provided where applicable.

Entrants must complete KYC verification and provide a valid bank account or other required details to claim Prizes.

Payment options and limits (minimum/maximum) are at the Company’s discretion and may change from time to time. Where appropriate, deposits must originate from a payment method owned by the Player. Third-party deposits are prohibited and may be confiscated along with any related winnings.

The Company is not a bank or financial institution. Deposited funds are not insured and must only be used for participation on the Platform.

The Company reserves the right to verify the source of funds and may suspend accounts pending verification in line with anti-money laundering (AML) regulations. Entry fees and deposits are non-refundable except in cases of technical error or draw cancellation as determined by the Company.

Bonuses, boosters, and other promotions may be offered from time to time, subject to specific terms, conditions, and expiry periods. Bonuses or promotional benefits not claimed within seven (7) days may be forfeited unless otherwise stated.

Boosters or promotional features may apply only to specified Draws and within specified time limits. The Company reserves the right to withdraw, amend, or suspend any promotion at its discretion.

Users must not:

• Use the Platform for unlawful, fraudulent, or money-laundering activities;
• Manipulate or interfere with Draw outcomes or the operation of the Platform;
• Deploy bots, scripts, or automated systems to gain an unfair advantage;
• Use the Platform as a means to transfer or conceal funds;
• Provide false, misleading, or incomplete information.

We reserve the right to monitor and restrict access in case of suspicious activities. Accounts engaged in prohibited activity may be suspended or terminated, with winnings forfeited. Information about such conduct may be shared with relevant financial institutions, regulators, and law enforcement authorities where required.

Prizes may include, but are not limited to, vehicles, electronics, travel experiences, vouchers, luxury items, or cash equivalents. Winners must complete KYC verification and provide valid identification and bank details, or any other information reasonably requested, to receive their Prize.

Prizes must be accepted as awarded and cannot be transferred, exchanged, or combined with other offers unless expressly stated by the Company. If a physical Prize cannot be delivered for logistical or regulatory reasons, a reasonable cash alternative will be offered in Nigerian Naira.

Winners are responsible for any taxes, customs duties, or charges associated with Prize collection unless otherwise stated. The Company is not responsible for loss, damage, or issues with a Prize after delivery or collection.

All content on the Platform, including text, graphics, design, trademarks, logos, and software, is the property of Drawmax LTD or its licensors. You may not copy, reproduce, distribute, modify, create derivative works from, or publicly display any material from the Platform without our prior written consent.

To the fullest extent permitted by law, Drawmax LTD, its affiliates, officers, and employees shall not be liable for:

• Any indirect, incidental, special, or consequential damages;
• Loss of data, loss of profits, loss of revenue, or business interruption;
• Any failure, delay, interruption, or unavailability of the Platform caused by third-party services, technical failures, or circumstances beyond our reasonable control.

Your use of the Platform is at your sole risk. The Platform is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, except as required by law.

You agree to indemnify, defend, and hold harmless Drawmax LTD, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use or misuse of the Platform;
• Your breach of these Terms;
• Your violation of any applicable law or the rights of any third party.

We comply with the Nigeria Data Protection Regulation (NDPR) and other applicable data protection laws. By using the Platform, you consent to the processing of your personal data for identification, fraud prevention, prize delivery, and compliance purposes.

We may suspend or terminate your account and/or access to the Platform at any time if you breach these Terms, engage in suspicious, fraudulent, or unlawful activity, or if we are required to do so by law or regulation.

Upon termination, all rights granted to you under these Terms will cease immediately. Any unpaid winnings may be withheld or forfeited where termination is due to breach or unlawful activity, subject to applicable law.

These Terms are governed by the laws of the Federal Republic of Nigeria. The parties shall first attempt to resolve any dispute amicably through good-faith discussions.

If a dispute is not resolved within thirty (30) days, it shall be referred to arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act. The arbitral award shall be final and binding on the parties, except as otherwise provided by applicable law.

We may revise these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business operations. Updated Terms will be posted on the Platform and will take effect once published, unless a different effective date is stated.

Your continued use of the Platform after the updated Terms are posted constitutes your acceptance of the changes.

Your rights and obligations under these Terms are personal to you and may not be transferred or assigned to any third party. No third party shall have the right to enforce any provision of these Terms.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Any delay or failure by us to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, and we may enforce it at a later date.

We will not be liable for any losses or damages arising from events beyond our reasonable control, including but not limited to acts of God, trade or labour disputes, actions or omissions of governmental authorities, failure of telecommunication networks, or delays caused by third parties. In such circumstances, we reserve the right to cancel or suspend our services without liability to you.

Any personal information you provide to us in the course of registering, signing up, or interacting with our services will be held and processed in strict accordance with our Privacy Policy and these Terms.
